The Honourable Justice Robert Stanley Montgomery died peacefully on December 31, 2023 at Sunnybrook Veterans Centre at the age of 98.

Survived by his loving wife Dixie Anne, his daughters Jo-Anne, Susan and Elizabeth, his son Gordon and his sister Dorothy Cameron of Port Elgin, son in laws Ted and Niel, daughter in laws Sue and Kerri, grandchildren Jillian, Mark, David, Jennifer, and Anne-Marie and 9 great grandchildren. Predeceased by his eldest daughter Barbara, his brother John a lawyer in Winnipeg, his father Dr. Stanley Montgomery, and his mother Janet (Hislop) Montgomery.

Born in 1925 in Southern Rhodesia, now Zimbabwe, where his father was a medical missionary and then educated in Toronto and Brampton after their return to Canada. After high school he joined the Royal Canadian Navy and then went on to attend the University of Toronto. He obtained his law degree at Osgoode Hall Law School.

Robert practiced as a litigator with Ferguson Montgomery Cassels Mitchell law firm which later became Montgomery Cassels Mitchell Somers Dutton Winkler. In 1977 he was appointed as a Justice to The Supreme Court of Ontario now known as The Superior Court of Ontario. He served on the bench for 20 years before he retired early to become a founding member of ADR Chambers practicing mediations and arbitrations until he was 88 years old. He was a Bencher of the Ontario Law Society, a Member of the Ontario Bar Association, and the Canadian Bar Association. He was a founding Member of the Advocate Society of Ontario, and was their 3rd President. This later became a national organization.

He was an ardent fly fisherman having travelled across Canada and the UK to catch trout and salmon. For 45 years he was a member of the Caledon Mountain Trout Club and was honored to be made their first Honorary Member. He was also a member of the Canard Shooting Club. He was an excellent tennis player and belonged to the Granite Club, The Badminton & Racquet Club of Toronto, and the Mulmur Hills Tennis Club of which he became an Honorary Member. He was a talented wood carver and artist and enjoyed teaching others to carve birds. He loved all his Labrador dogs and trained them well. The family spent 38 years at their Mulmur Hills weekend country home and over 30 years of winter months in Florida at Palm Beach, Naples, and Marco Island.

As per his wishes there will be no funeral service and his cremated remains will be interred at Mount Pleasant Cemetery. The family extends sincere gratitude to the excellent nurses, doctors, and staff at Sunnybrook Veterans Centre, for their care and concern during his 3 1/2 months of residency. In lieu of flowers and if desired, a donation may be made in his name to Sunnybrook Health Sciences Centre, specifically to the Veterans Centre or a charity of your choice.
